We have to share a lot of legal information and disclaimers with you, but don't let it scare you. To keep it short, we will respect you, keep your information secure and do our very best to provide you with high quality content in a safe and secure environment and deliver what we promise. You, in turn, will not do anything that is mean to others or illegal.  Here's the nitty gritty in legal terms.


Exchanges/Returns:


The membership plan for ITA is non-refundable and non-transferrable. That being said, we want you to be very, very happy with your plan. If, for whatever reason, the content falls short of your expectations, please contact us so we can try to make it right.


Your Account:


Your account and your membership are exclusive for you. This means that you are responsibility for maintaining the confidentiality of your account and password and you accept responsibility for all activities that occur under your account or password.  You may not assign or otherwise transfer your account to any other person or entity. You also acknowledge that ITA is not responsible for third party access to your account that results from theft or misappropriate of your account.


Please be careful when giving out any personally identifying information about yourself or your dependents on this site (and everywhere actually).  We must specifically disclaim any liability with regard to your sharing of information and also know that views of others do not necessarily reflect those of ITA.


Termination/Access Restriction:


We welcome you as a member but please know that if you break the rules, we will terminate or otherwise restrict your access. We reserve the right, at our sole discretion, to terminate your access to the Site and related service at any time and without notice if you breach the Terms and Conditions.  


Privacy:

 

Of course we have to have a Privacy Policy which you can review on our site  so that we can tell you about our data collection practices. When you agree to the Terms & Conditions, you also agree to the Privacy Policy.  

 

Intellectual Material/Copyright:


We worked hard to create the courses and the content published on this site and we ask that you not take it.  You will use our content solely for your personal use and will make no other use of the content without express authorization.  All content including the courses, text, graphics, logos and images, as well as the compilation therefore and any software used on this Site is the property of ITA or its suppliers and is protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions and will not make any changes to our content.  You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works or in any way exploit any content in whole or part that you find on this site.  Our content is not for resale.  Your use of this Site does not entitle you to make any unauthorized use of any protected content and, in particular, you will not delete or alter any proprietary rights or attribution notices in any content.   


No Unlawful or Prohibited Use:


When you join, you are granted a non-exclusive license to access and use the site strictly in accord with these Terms of Use. As a condition of your use of this site, you warrant to ITA that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden or impair the Site or interfere with any other party's use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.


Your Communications:

However, ITA reserves the right to review materials posted to a Communication Service and to remove any materials at our sole discretion. ITA reserves the right to terminate your access to any or all of the Communication Services.   ITA also reserves the right at all times to disclose information as necessary to satisfy any applicable law, regulation, legal process or government request or to edit, refuse to post or to remove any information or materials at our sole discretion.

 

Your Material:

 

ITA does not claim ownership of the materials you provide, post, upload, input or submit to our site or any of our associated services (collectively "Submissions").  By posting, uploading, inputting, providing or submitting your Submission, you warrant and represent that you do own or otherwise control all the rights to your Submission.  That being said, by posting, uploading, inputting, providing or submitting your Submission, you are granting ITA, our affiliated companies and necessary sublicensees permission to use your Submission in connection with the operation of their Internet business including, without limitation, the right to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission and to publish your name in connection with your Submission.  No compensation will be paid with respect to the use of your Submission.  ITA is under no obligation to post or use any Submission you may provide and may remove any Submission at any time at ITA's sole discretion.

When you visit this site or send emails to ITA, this is electronic communication.  When you sign up, you agree that all notices, disclosures and other communications that we provide to you electronically, via email and on the site satisfy any legal requirement that such communication be in writing.

Our site may contain links to other websites ("Linked Sites"). The Linked Sites are not under our control and ITA is not responsible for the content of any Linked Site.  ITA is providing these links as a convenience and the inclusion of any link does not imply endorsement by ITA of the site or any association with its operators.  That being said, certain services that we provide are delivered by third party sites and organizations. Children Under Thirteen:


ITA does not knowingly collect - either offline or online - personal information from persons under the age of 18.  If someone under the age of 18 was actually interested in this site or our content, they can only use the information with permission of a parent or legal guardian.


International Users


This Site is controlled, operated and administered by ITA from our offices within the USA.  If you access this Site from a location outside of the USA, you are responsible for compliance with all local laws. You agree that you will not use ITA content in any country or in any manner prohibited by any applicable laws, restrictions or regulations.


Indemnification:

Arbitration:


In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tart or otherwise at law or inequity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrators award shall be final, and judgment may be entered upon it in any court having jurisdiction.


Liability Disclaimer:


The information, software, products and services included or available through the Site may include inaccuracies or typographical errors. Changes are periodically added to the information contained herein. ITA and/or its supplies may make improvements and/or changes to the site at any time.
